Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between AveQue ("we", "us", "our", "AveQue") and the enterprise organization ("Client", "you", "your") that has been granted access to AVQ Muse. By accessing or using AVQ Muse — including the web dashboard and the AVQ Muse Figma plugin — you confirm that your organization has accepted these Terms.

AVQ Muse is an enterprise-only platform. Access is granted exclusively to organizations that have entered into a formal agreement with AveQue. Unauthorized access is prohibited.

AVQ Muse is an enterprise creative automation platform that enables design teams to generate marketing banners within Figma using organization-specific templates, brand assets, and configuration. The platform includes:

• The AVQ Muse Figma Plugin (available through the Figma Community)
• A web-based management dashboard for organization administrators
• Backend services for authentication, configuration management, and analytics
• Onboarding and configuration support from the AVQ team

3.1 Invite-Only Access. AVQ Muse does not offer public signups. Access is granted exclusively through invitation. Every user account is created by an authorized administrator and is tied to a specific organization.

3.2 Account Responsibility. Each organization is responsible for all activity occurring under its workspace. Organization Admins are responsible for managing user access, revoking invitations when users leave the organization, and maintaining the confidentiality of credentials.

3.3 Permitted Users. Access is limited to authorized personnel of the Client organization. Sharing credentials with or granting access to third parties outside the organization is prohibited without written consent from AveQue.

You agree not to:

• Attempt to access another organization's data, users, or configuration
• Use AVQ Muse to generate content that violates applicable laws or intellectual property rights
• Reverse engineer, decompile, or attempt to extract source code from any component of AVQ Muse
• Use automated means to scrape, crawl, or extract data from AVQ Muse beyond normal plugin usage
• Introduce malicious code, viruses, or exploits into the platform
• Resell, sublicense, or provide access to AVQ Muse to parties outside your organization
• Upload or generate content that is illegal, defamatory, or infringes third-party rights

5.1 Platform Ownership. AVQ Muse, including all software, features, UI, and underlying technology, is the exclusive property of AveQue. These Terms do not transfer any intellectual property rights to you.

5.2 Client Content. You retain full ownership of your brand templates, assets, product data, and any creative outputs generated by the platform using your organization's configuration. AveQue does not claim any rights over your templates, brand assets, or generated banners.

5.3 License to Operate. By uploading or configuring assets within AVQ Muse, you grant AveQue a limited, non-exclusive license to store and process that content solely for the purpose of providing the service to your organization.

Your use of AVQ Muse is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key commitments include:

• Complete data isolation between organizations
• No sale or sharing of your data with third parties for marketing
• Encrypted data transmission and secure credential storage
• Data export and deletion upon enterprise agreement termination

7.1 Uptime. AveQue will use commercially reasonable efforts to maintain service availability. Planned maintenance will be communicated in advance to Organization Admins. AveQue is not liable for service interruptions caused by third-party infrastructure, force majeure events, or issues outside our reasonable control.

7.2 Support. AveQue provides support to Organization Admins. Support scope, response times, and SLAs are defined in your enterprise agreement.

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with this agreement, including but not limited to pricing, configuration details, product roadmaps, and technical specifications. This obligation survives the termination of the enterprise agreement for a period of three (3) years.

To the maximum extent permitted by applicable law:

• AVQ Muse is provided "as is" and "as available" without warranties of any kind
• AveQue's total liability to any Client shall not exceed the fees paid by that Client in the twelve (12) months preceding the claim
• AveQue shall not be liable for indirect, incidental, special, consequential, or punitive damages
• AveQue is not liable for loss of data resulting from actions taken by your organization's administrators or users

10.1 By Client. You may terminate your use of AVQ Muse by providing written notice to AveQue. Termination does not entitle you to a refund of any prepaid fees.

10.2 By AveQue. AveQue may suspend or terminate your access immediately if you breach these Terms, fail to pay applicable fees, or engage in conduct that threatens the security or integrity of the platform.

10.3 Effect of Termination. Upon termination, your organization's access is revoked. Data will be retained for 30 days for export and then permanently deleted, per the Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of AVQ Muse shall be subject to the exclusive jurisdiction of the courts of India. Both parties consent to personal jurisdiction in such courts.

AveQue reserves the right to update these Terms. We will notify Organization Admins of material changes with at least 14 days' notice via email. Continued use of AVQ Muse after the effective date constitutes acceptance of the revised Terms.
